Tucson Municipal Court Judge Eugene Hays has finally proved just why the Tucson City Council holds it collective nose and keeps him on the bench.  

On December 27, 2006, in Warden’s second criminal prosecution for events surrounding the Burning of the Mexican Flag, Judge Hays delivered the goods...

He kept his promise to local left wing politicians and Mexican Agent (and Pima County Legal Defender)  Isabel Garcia, took off the gloves, and convicted Warden, the Notorious Mexican Flag Burner.  

Just like he said he would.

It was a classic performance of the corrupt Pima County Criminal Justice system at it finest.

More importantly, Judge Hays’ ruling  sets up a classic battle between two eternal antagonists: the Rule of Law vs the Rule of Men.  

“Our founding fathers gave us a constitution in which the fundamental power of the law vested entirely with the People, not with politicians and Government.

“Constitutionally, law has only two purposes: to protect We the People from each other, and to protect We the People from Government. 

“Now, here in Pima County we will all witness this conflict, first hand. We will all witness the supremacy of the Rule of Law over the Rule of Men. 

“By the time I’m done with Judge Hays up at the Arizona Supreme Court,” says Warden, “he will join Ken Peasley as one of the most reviled legal figures in Arizona history.

Sit back and watch me kick Judge Hays right off the bench!”  

Several years ago in the New Yorker, Jeffrey Toobin exposed Barbara LaWall and her favorite prosecutor Ken Peasley, for fixing a capital murder case in Killer Instincts.  

Documents filed at the Tucson Municipal Court reveal:

1.      TPD allowed complaining witness Arturo Rodriquez, “a proud member of MEChA” to break the chain of custody and “doctor” the film evidence the state used to convict. “The film presented at trial was altered to destroy valuable exculpatory evidence,” said Warden.

2.     Prosecutor Alan Merritt refused to turn over the original film provided by Rodriguez, as required by law.

3.     The original film reveals one of the Pendejo Thugs encouraging Arturo Rodriguez, in Spanish, to “Hit Warden, hit him!. He is an old man. He can’t do anything.”

 4.    When Warden politely extended an opportunity to Arturo Rodriguez to speak his views on immigration, Rodriquez responded: “I want to fuck your mother. I want to fuck your wife!”  

5.     Judge Hays and Pima County Legal Defender Isabel Garcia worked in concert, so Garcia could occupy a strategic position in the court, obscured from judicial view, and direct the testimony of Arturo and Alexander Rodriguez.

6.     Pima County Legal Defender Isabel Garcia used facial expressions and hand gestures to give repeated signals to Arturo and Alexander Rodriguez when they testified.   “It was the most shocking thing I’ve ever seen in a court of law,” said Laura Leighton, court observer and former employee of the Tucson City Public Defender.  

Even more outrageous: On December 15, 2006 Isabel Garcia served Warden with an Order of Protection which barred Warden from attending the completion of his own trial on December 27, 2006.

“I have too much respect for the Rule of Law to disobey an Order of the Court,” said Warden, “even if that Court Order prevents me from attending my own trial.

“Judge Hays should have granted the continuance I asked for so I could challenge the Protective Order in the only manner prescribed by law. He should have held a hearing to determine the full extent of Isabel Garcia’s witness tampering.

“Judge Hays did none of these things. He just flexed his muscles and shoved it down my throat.

“The lines now are clearly drawn,” says Warden.

“I’ve stuck out my neck and fully exposed myself to enemy fire. I've revealed the corrupt Pima County Criminal Justice System, Pima County's active promotion of Mexican foreign policy, and the left wing conspiracy to flood America with millions of Alien Illegal Mexicans  to create a new nation called ‘Aztlan’.

I will now exercise the Rule of Law and call upon the American people and the Appellate Courts to protect me.” 

America is the Stronghold. We will not permit the ignorant, the unwashed and the savage to overrun us. Here in Pima County we Americans will make our stand!”
