When Arizona State Superintendent of Public Education Tom Horne appeared yesterday on the Jim Parisi Show, 790 Newstalk, to speak to Tucsonans regarding the need to end “Raza” Studies at TUSD, he was speaking to some of the choir.
It turns out that a local activist group, Arizonans for Immigration Control, was a major motivating force behind Horne and Jonathon Paton’s Bill SB 1069 which, if passed, will altogether end TUSD’s entire Ethnic Studies Department. |

The Black Panther Party, founded in
Oakland
California
by Huey Newton, Bobby Seale and David Hilliard, was later joined by Eldridge Cleaver, George Jackson and other local black political activists.
In the late 1960's Warden worked in the San Francisco Bay Area as a legal researcher and investigator for attorneys representing political activists, local rock and roll bands and big time, high profile international drug dealers. These associations brought him into close contact with some of the most influential people of that era. Some of the attorneys he worked with went on to become prominent federal prosecutors and appellate court judges.
Today, these friends, some still in practice or on the bench, have formed a sort of informal "Brain Trust" to advise Warden on legal issues, federal judges, federal courts generally and appellate court procedure.
In Alameda County California in the 1960's, Warden's father Lew, an attorney, was politically prominent and popular within the revolutionary and black community for his willingness to take on the Oakland Police Department for the murder of black activists.
This popularity gave Warden currency and credibility with black political activists and the black revolutionaries of that era. He claims no friendships with any of them, but he did know them. And they tolerated him. Perhaps they were pleased Warden did not pander to their blackness, kiss their ass or give them any white boy jive. Warden might have been the only white dude of that era who could occasionally use the word "Nigger" in their presence without getting thumped.
Two books in particular describe the
San Francisco
scene in the late sixties, and the combination of sex, drugs, rock and roll, and revolutionary politics: Nark by Joe Eszterhas and Acid Dreams.
In 1971 in
Algeria, Warden ran into Eldridge Cleaver, former "Minister of Information" of the Black panther Party, who was hanging out with Tim Leary in
Algiers. Eldridge introduced Warden to some Algerians who were forming an organization to kick
Spain
out of what now is referred to as the
Western Sahara
, a group that eventually would be known as "Polisario." Several months later these guys saved Warden's life outside a small settlement in the northern
Sahara
Desert
, a place called Tindouf.
Both Eldridge and Leary, (who was busted out of federal prison by the Brotherhood) were on the lam from the feds. Warden found Cleaver to be an interesting man; Tim Leary, who later turned in members of The Brotherhood who helped him, was an Asshole. |

vs Charles Ken Walter, effectively suspended the foundational premise of

TPD officers,
acting on instructions from Open Border Lobby spokesman John Martin,
arrested community activist Russ Dove as he tried to enter what had been advertised as a public meeting at the
Armory
Park
Community Center
on August 17
,
2006.
TPD also prevented Warden,
the Notorious Mexican Flag Burner,
and a small group of protestors from gathering on a sidewalk across the street,
facing the entrance to the meeting,
and moved them 1/2 block away to the corner of 12th Street and South Fifth Avenue.
“They had no lawful authority for preventing Dove’s entry into a public meeting or for moving us," declared Warden. “Clearly TPD intends to prevent us from communicating our message to the OBL, the Mexican Illegals,
and the public officials,
including Congressman Raul Grijalva,
who aid and abet their violation of American immigration law.”
Additionally,
TPD officers directed by Assistant Chief Robinson
,
prevented Warden from using a bullhorn,
the same device he employed without incident in front of the Tucson Municipal Court on August 04
to communicate a political message.
“For more than 60 years the US Supreme Court has been quite specific protecting the use of bull horns and other sound enhancing devices to communicate political messages," said. Warden. “We were completely within our rights. I even cited Robinson Saia v
New York,
our case authority. Robinson couldn’t even name the ordinance or statute she claimed we were in violation of. She just said
,
‘Stop,
or you’ll be arrested.’
“We will be going to federal court for an injunction,
to address the Tucson City Ordinance which permited TPD and the OBL to discriminate against Dove,
and to protect our rights to communicate a political message by use of a bullhorn.
“The
Tucson
City
government’s violation of our constitutional rights mirror the racist policies of the south in the 50’s and 60’s when black Americans were first beginning to organize.
Tucson
City officials are about to learn,
as the southern racists learned,
the supremacy of federal law. No matter how much Mexican ass they kiss today,
they're going to learn
Tucson
is still part of
America,
not
Mexico."
Warden expects the Tucson Police Department to continue to maintain public order,
as they did in front of the Municipal Courthouse on August 04 and near
Armory
Park
on August 17.
“The police finally seem to get it. They know if they fail to protect our safety,
we are prepared to take all lawful steps to protect ourselves," Warden declared.
“And this means,
‘Boom
,
Boom
,
Boom!’”
Warden says he will continue to create a small roped off area at every protest,
from which he and others will speak
,
commit symbolic acts protected by the First Amendment,
and burn more Mexican Flags.
"Tucson
officials and the Pendejo Thugs are beginning to understand what my roped off area means," said Warden. “It means: unless you represent the Tucson Police Department,
or are expressly invited in,
stay the freak out. I don’t give a damn who you are; the media

whoever. If you enter my zone uninvited,
I will consider it an attempt on my life and put you down.”
“The Pendejo Thugs got away with assaulting Tucson Police Officers on April 10. They ever try that crap with me; jump on my back

Community puts
Tucson
on Trial for Police and Vigilante
Violence at Historic April 10th March
September 20,

) - “If anyone else had put bruises on my daughter’s face like that,
they would have been punished,
but the police don’t have to answer to anyone,
” said Maricela García,
the mother of an 11-year old girl who was struck in the face by a police officer at the largest march in Tucson’s history. Across the country,
millions marched for human,
civil and worker rights for immigrants on April 10,
2006,
but
Tucson
was the only city where armed vigilantes and police attacked peaceful protesters.
In response,
the
Tucson
April 10th Coalition will present a multi-media theater performance entitled
,
Tucson
on Trial,
this Saturday
,
September 23,
2006 at 5:00 p.m. at
Sunnyside
High School. This community event will raise awareness about the links between police violence,
vigilante violence and border militarization. The performance will also call on the City of
Tucson Immigrant Rights Rally
in
Armory
Park
in
Tucson
to take responsibility for the police and vigilante attacks against the community at the April 10.
The City of
Tucson
and the Tucson Police Department allowed Roy Warden and armed members of the hate group,
Border Guardians,
to incite violence at the rally by burning Mexican flags and shouting racial slurs in the middle of 15,
000 demonstrators. Instead of keeping the vigilantes at a safe distance from
Armory
Park
to protect demonstrators,
Tucson
police themselves charged the crowd,
pepper-spraying youth,
shouting racist insults and throwing people to the ground. Without justification,
police then arrested 6 demonstrators,
charging them with purportedly resisting arrest and disorderly conduct.
“On Saturday we will send a strong message to the City that we will not accept this upsurge of official and unofficial violence against our community. April 10th was a glaring example of how the militarization of the border region is breeding repression,
posing great risks to our personal safety and promoting impunit," said Nancy Gallen,
a former school teacher and member of the April 10th and Derechos Humanos Coalitions.
The Tucson April 10th Coalition has repeatedly gone to the City Council to demand that the records of the six marchers arrested be cleared,
that the City of Tucson conduct an independent investigation of the police brutality on April 10,
that the City of Tucson and TPD issue a public apology to the community and that the City guarantee that the community can engage in peaceful protest in the future without risking their personal safety. Despite City Manager Michael Rankin’s acknowledgment that “mistakes were made” on April 10,
the City has refused to take responsibility for the police and vigilante violence that occurred.
Vigilante Roy Warden was eventually charged with assaulting a Fox News cameraman at the April 10 rally and with criminal damage for the fires he set at the rally site. Warden has also been charged with a separate assault against a Chicano 14-year old,
which took place in front of
Tucson's Mexican Consulate in June. In addition,
Warden has emailed death threats to community leader,
Isabel García,
made general death threats to anyone who “crosses his perimeter,
” and disrupted numerous immigrant rights events in
Tucson
by burning Mexican flags,
shouting hate speech and intimidating participants.
Members of the community are invited to attend the
Tucson
on Trial theater performance,
which will be held at the Sunnyside High School Auditorium (1725
E. Bilby,
at Campbell Avenue,
Tucson ) on Saturday,
September 23,
2006 at 5:00 p.m.

when a frustrated Judge Hays conceded defeat,
